1. What this service is

Flinch sells one advertising position at the top of flinch.auction by descending-price auction. The price falls over time; the first buyer to accept the displayed price buys at that price. Flinch is operated by Muddy Holdings LLC.

2. No chance element

This is a sale at a posted price, not a game of chance. No consideration is ever staked on an uncertain outcome. You see the price before you commit, and if you do not buy you pay nothing. There is no pot, prize draw or wager of any kind.

3. How long you hold the position

You hold the position from the moment your payment settles until the next buyer completes a purchase. That period is not fixed, not guaranteed, and may be as short as minutes. You are buying a position, not a duration. Do not buy if a minimum exposure time matters to you.

4. Claims and the frozen clock

Starting a purchase reserves the displayed price for two minutes and freezes the clock for all visitors. If you do not complete payment in that window the reservation lapses, no charge is made, and the clock resumes from where it stopped. Only one reservation can be open at a time.

5. Your content

You are responsible for the name, line and link you submit, and you confirm you have the right to use them. You grant us a licence to display them on this site and in the permanent public ledger for as long as we operate it.

6. What we remove

We may remove a listing without notice if it links to malware or phishing, contains adult or illegal material, impersonates a real person or company, or breaches Stripe's restricted businesses list. A listing removed under this clause is not refunded.

7. Links are nofollow

All outbound links carry rel=sponsored nofollow. Nothing sold here confers search-engine ranking benefit, and we make no representation that it does.

8. No warranty

The service is provided as-is. We do not guarantee traffic, clicks, conversions, uptime, or that any particular number of people will see your listing. Click counts shown are our own measurements and are indicative only.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of the service is limited to the amount you paid us for the round in question.

10. Changes

We may change the auction parameters — the opening multiplier, the floor, the decay period — for future rounds. Changes never apply retroactively to a round already in progress or already sold.
